Terms of Service

1. Acceptance of Terms

By accessing or using Tractn ("the Service"), operated at app.tractn.io, you agree to be bound by these Terms of Service, our Privacy Policy, our Acceptable Use Policy, and our Data Processing Agreement. If you do not agree to all the terms, you may not access or use the Service.

2. Description of Service

Tractn is a SaaS AI Marketing Operating System that provides:

  • 15 AI-powered marketing agents for strategy, content, analytics, and execution
  • Unified marketing analytics dashboards across all channels
  • Social media scheduling and cross-platform publishing
  • Email automation with drip sequences and engagement tracking
  • Lead management CRM with conversion tracking (Tractn Pixel)
  • Competitor analysis and market intelligence
  • SEO research and keyword intelligence
  • Integration with third-party marketing platforms (Google, Meta, LinkedIn, X, etc.)

3. Account Registration

To use Tractn, you must:

  • Create an account using a valid email address or Google Sign-In
  • Provide accurate and complete registration information
  • Be at least 16 years of age
  • Maintain the security of your account credentials

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use at support@tractn.io.

4. Third-Party Integrations

Tractn connects to third-party platforms (Google, Meta, LinkedIn, X, TikTok, etc.) via OAuth 2.0 to access your marketing data. By connecting these platforms:

  • You authorize Tractn to access and display your analytics data
  • You confirm you have the authority to grant such access
  • You can revoke access at any time through the Connections settings page or directly from the third-party platform

Tractn is not responsible for the availability, accuracy, or policies of third-party platforms. Your use of those platforms is governed by their respective terms of service.

5. Tractn Pixel & Data Collection

Tractn provides a JavaScript tracking pixel that you can embed on your website to track conversion events and capture leads. By using the Tractn Pixel:

  • You are the Data Controller for all personal data collected through the pixel on your website
  • You are responsible for maintaining a compliant privacy policy on your website that discloses the use of the Tractn Pixel
  • You must obtain appropriate consent from your website visitors where required by law (e.g., GDPR opt-in for EU visitors)
  • You must comply with all applicable data protection laws in your jurisdiction

Tractn processes this data on your behalf as a Data Processor, in accordance with our Data Processing Agreement.

6. Email Automation

Tractn provides email drip sequence capabilities. By using these features:

  • You are solely responsible for ensuring you have lawful consent to email your recipients
  • You must include unsubscribe mechanisms in your marketing emails
  • You must comply with CAN-SPAM (US), CASL (Canada), GDPR (EU), and all applicable email marketing laws
  • Tractn reserves the right to suspend email sending for accounts with excessive bounce rates or spam complaints

7. AI-Generated Content

Tractn uses artificial intelligence (powered by Anthropic's Claude) to generate marketing strategies, content, research, and recommendations. You acknowledge that:

  • AI-generated content is provided as suggestions and should be reviewed before use
  • You are solely responsible for reviewing, editing, and publishing any content generated by Tractn
  • Tractn does not guarantee the accuracy, originality, suitability, or effectiveness of AI-generated content
  • AI-generated content may not be eligible for copyright protection under current law — this area of law is evolving
  • Content generated for your account is owned by you upon creation, subject to the limitations above
  • You indemnify Tractn against claims arising from your publication or distribution of AI-generated content
  • No end-user personal data (lead emails, names, phone numbers) is sent to AI models

8. Acceptable Use

Your use of Tractn is subject to our Acceptable Use Policy. You agree not to:

  • Use the Service for any unlawful purpose
  • Send unsolicited commercial emails (spam)
  • Generate illegal, defamatory, discriminatory, or deliberately misleading content
  • Attempt to gain unauthorized access to other users' accounts or data
  • Reverse engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Circumvent rate limits, usage quotas, or security controls
  • Resell, sublicense, or redistribute the Service without authorization
  • Use automated tools to scrape or extract data from the Service

9. Intellectual Property

The Service, including its design, code, logos, AI agent architectures, and documentation, is owned by Tractn and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without written permission.

Content you create or upload remains your intellectual property. By using the Service, you grant Tractn a limited, non-exclusive, non-transferable license to process and display your content as necessary to provide the Service.

10. Pricing & Payments

Tractn offers free and paid subscription tiers. By subscribing to a paid plan:

  • You agree to pay the applicable fees as described on our pricing page
  • Fees are billed in advance on a monthly or annual basis
  • Subscriptions auto-renew at the end of each billing period unless cancelled
  • You can cancel your subscription at any time — cancellation takes effect at the end of the current billing period
  • Refunds for partial periods are generally not provided, except as required by law
  • We reserve the right to modify pricing with 30 days' prior notice

Payments are processed by Stripe. Tractn does not store or have access to your payment card details.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime.

12. Limitation of Liability

To the maximum extent permitted by law, Tractn and its affiliates, officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or reputation, arising from your use of the Service.

Our total aggregate liability for any claim arising from the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

This limitation applies whether the claim is based on warranty, contract, tort (including negligence), strict liability, or any other legal theory.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Without limiting the foregoing, Tractn does not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, or error-free
  • AI-generated content will be accurate, complete, or suitable for any purpose
  • Marketing results or performance outcomes will be achieved
  • Third-party platform integrations will always be available or function correctly

14. Indemnification

You agree to indemnify, defend, and hold harmless Tractn and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service in violation of these Terms
  • Your publication or distribution of AI-generated content
  • Your collection, processing, or use of personal data through Tractn tools
  • Your violation of any applicable law or regulation
  • Your infringement of any third-party rights

15. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. You may delete your account at any time through the account settings.

Upon termination:

  • Your right to use the Service ceases immediately
  • You may request an export of your data before deletion
  • We will delete your data within 30 days, in accordance with our Privacy Policy
  • Provisions that by their nature should survive (limitation of liability, indemnification, governing law) will remain in effect

16. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Zurich, Switzerland.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
